USA Today Publishers Sue OpenAI Over Training and Outputs

USA Today Co. and thirteen affiliated publisher entities filed a 79 page complaint against OpenAI entities in the Southern District of New York on October 8, 2026, No. 1:26-cv-08892. The complaint concerns nineteen publications and alleges unauthorized copying for model training, competing outputs and removal of copyright management information. It identifies more than 160,000 entries from the publishers' content in the WebText dataset, not a verified count of distinct copied articles. The plaintiffs seek damages in excess of $250 million and request destruction under 17 U.S.C. Section 503(b) of models and training sets incorporating their content. They also filed a statement seeking treatment as related to the consolidated OpenAI copyright litigation. These are allegations and requested remedies, not findings of infringement or relief the court has ordered. No defendant response deadline is established here.

PARADIGM INSIGHTS:

Training use, alleged output substitution and the requested remedies should be evaluated separately. A complaint can identify those disputed issues without establishing liability, the recoverable damages or whether destruction of a model or dataset will be ordered.
