UNCITRAL Adopts Texts on Electronic Arbitral Awards and Notices
UNCITRAL adopted texts facilitating the use of electronic arbitral awards and notices of arbitration.
PARADIGM INSIGHTS:
Electronic notice is useful when a party can prove who received what and when; an electronic award is useful when its identity and integrity can be checked at enforcement. The new UNCITRAL texts address format friction, not the underlying questions of consent, due process or the law of the seat. A digital dispute forum should make those facts easier to prove, not hide them behind an upload button.
