Singapore Court Rejects Tata Power's Challenges to SIAC Award
The Singapore International Commercial Court dismissed Tata Power's three applications concerning an arbitration award of roughly US$490 million in favor of Kleros Capital Partners. The challenges raised procedural fairness and alleged arbitrator bias, including nondisclosure of prior work involving a third-party funder. The court rejected the applications; the judgment illustrates disclosure and set-aside standards. Note: Kleros Capital Partners is an investment firm, not the blockchain arbitration protocol.
PARADIGM INSIGHTS:
This rejected challenge shows why arbitration legitimacy is built early, not repaired after the award. Record an arbitrator's relevant work and funding ties, give the parties a timely chance to object and preserve that record for court review. The court did not hold that every funder connection invalidates an award. The design lesson is disclosure that survives scrutiny.
