Italy Publishes AI Liability Decree, Effective September 30
Italy's Legislative Decree No. 160/2026, published September 15, entered into force on September 30. The decree addresses police uses of AI and civil and criminal liability. Its new Criminal Code Article 437-bis addresses specified failures to adopt security or human-oversight measures for high-risk AI systems where the omissions create danger to life or public or individual safety, with higher penalties where state security is endangered. It does not criminalise every AI governance failure.
PARADIGM INSIGHTS:
The decree ties AI governance and potential liability more closely together. Documentation of oversight and security decisions may become important in later disputes, but the text is not a general right to bypass courts through arbitration.
