ICBA Challenges OCC National Trust Bank Rule

The Independent Community Bankers of America announced an October 2, 2026 lawsuit in the U.S. District Court for the District of Columbia against the OCC and the Comptroller. The complaint challenges the March 2 final rule, Interpretive Letter No. 1176 and Protego’s conditional national trust bank charter approval. ICBA alleges that the OCC exceeded its statutory authority by allowing substantial non-fiduciary activity under trust-bank charters. Those allegations are not a court ruling, and no charter freeze or final outcome is established here.

PARADIGM INSIGHTS:

The dispute concerns the boundary of federal chartering authority and safeguards for digital-asset businesses. It is a regulatory challenge, not proof that crypto-related trust charters have been invalidated.
