D.C. Circuit Upholds Claude Supply-Chain Exclusion
The U.S. Court of Appeals for the D.C. Circuit rejected Anthropic's challenge to the Department of War's exclusion of Claude from its supply chain on September 25. The court found support in the record for the Department's assessment under the Federal Acquisition Supply Chain Security Act: model restrictions had stopped Claude from carrying out some government-requested tasks, and a dispute over contractual use restrictions had left officials uncertain whether it would perform as needed. The opinion addresses this procurement decision and this record. It does not declare AI safety guardrails generally unlawful.
PARADIGM INSIGHTS:
The case exposes a governance problem that a contract alone may not solve: a buyer needs to know what a model may refuse, when those limits can change, and how disputes over a deployment are recorded and reviewed. Transparent testing and a defined challenge process can make safety boundaries easier to assess without pretending that every restriction is the same risk.
