BIA Designates AI-Related Reciprocal Discipline Decision as Precedent

On October 1, 2026, the Board of Immigration Appeals designated Matter of Sethi, 30 I&N Dec. 112, as precedent. The decision was previously issued unpublished on September 15. It imposes six months of reciprocal suspension before the Board, Immigration Courts and DHS, effective June 13, 2026, following the Ninth Circuit’s discipline for fabricated authorities and lack of candor. October 1 is the precedent-designation date, not the start of the suspension.

PARADIGM INSIGHTS:

AI-assisted drafting does not remove a practitioner’s duties to verify authorities and be candid with the tribunal. The decision applies existing discipline rules to misconduct; it does not impose a general prohibition on AI tools.
