Australia Fair Work Commission Issues GenAI Case Guidance
The Fair Work Commission published GenAI case guidance, applicable from Oct. 20, requiring users to disclose when and how they used GenAI, check accuracy and relevance, and personally verify witness statements and declarations.
PARADIGM INSIGHTS:
A tribunal cannot test an AI-assisted submission if no one can say what the tool supplied or who checked it. Disclosure, source verification and personal responsibility for witness evidence make the record contestable. The Fair Work Commission's guidance is scheduled to apply from October 20; it is not a finding about any case already heard.
